Terms and Conditions

This Rental Agreement and Contract (the “Agreement”) constitutes a legally binding agreement made as of the reservation date specified below, between the undersigned guest(s) or company (the “Guest”) and Aqua Divina, the owner, manager, or agent (“Rental Agent”), under which the Guest agrees to rent the property described herein (the “Property”), for the duration specified under the Rental Term for the Total Rental Fee and other considerations as outlined.

Condition and Use of Property

The Property is offered in its advertised condition. Aqua Divina commits to ensuring the functionality of all amenities within the Property, such as internet access, satellite or cable TV, hot tubs, and fireplaces, as applicable. 

Aqua Divina is not liable for the malfunction of these amenities but will endeavor to resolve any reported issues promptly. The Guest agrees to use the Property responsibly, particularly amenities that may pose risks if misused. 

The Property is to be used solely for residential purposes, maintained in a clean and sanitary condition, and not used for any unlawful activities or behaviors that could disturb the peace.

Waiver of Liability

The Guest and their invitees voluntarily assume all risks of personal injury, death, or property damage occurring on or around the Property, releasing Aqua Divina and its agents from any claims related to injuries, death, or damage sustained during the stay.

Default

Should the Guest fail to adhere to this Agreement, they must vacate the Property, leaving it in good condition and free of damage. 

No refunds will be provided for any portion of the Total Rental Fee in such cases, and legal actions may result in the responsible party bearing all associated costs.

Assignment or Sublease

The Guest is prohibited from assigning, subleasing, hosting large gatherings, or allowing the Property’s use by individuals not accounted for in the Agreement.

Indemnification

The Guest agrees to indemnify Aqua Divina against any claims or expenses arising from their use of the Property, including those of their guests, during the lease term.

Entry and Inspection

Aqua Divina reserves the right to enter the Property with prior notice to the Guest for maintenance, repairs, or inspections.

Unavailability of Property

Should the Property become unavailable due to unforeseen circumstances, Aqua Divina will make every effort to find a comparable replacement. 

If a suitable alternative is not found, all payments made by the Guest will be refunded, terminating this Agreement without further obligations from either party.

Swimming Pool

The Guest acknowledges the absence of lifeguards and assumes full responsibility for the safety of themselves and their guests when using the pool.

Cancellation

Cancellations made 60 days before the start of the lease term are eligible for a full refund minus banking fees. 

Cancellations made within 60 days of the lease term will result in the forfeiture of the rental amount. Aqua Divina recommends the purchase of travel insurance to cover unforeseen cancellations.

Eviction, Law, and Agency

Aqua Divina reserves the right to evict the Guest without notice for breaches of this Agreement, with no refund provided. This Agreement is governed by the laws of the Turks and Caicos Islands, and any disputes will be managed by Aqua Divina or its designated agent.

Septic System

The Guest agrees not to flush anything other than toilet paper to avoid damaging the natural bacterial process of the septic system.

Non-Smoking / No Animals

The Property is strictly non-smoking, and animals are not permitted. Violations will incur a $300 cleaning fee plus additional charges if necessary.

Acknowledgement

By signing below, the Guest(s) confirm they have read, understood, and agreed to abide by these terms and conditions, representing all parties included in the guest list.

The credit card provided at the time of reservation will be held for security purposes only. Charges will be applied only for unpaid rent, excessive cleaning, damages, lost keys, or lock-outs as necessary.

This document is legally binding, confirming that the Guest has reviewed and agreed to all terms and conditions herein.
